Author Agreement
THIS IS AN AGREEMENT BETWEEN THE USERS OF THIS WEBSITE AND THE SITE OWNER. PLEASE READ THIS AGREEMENT CAREFULLY.
The Phanichkul Group, dba TakingStuffApart.com, a San Diego company whose principal place of business is located in San Diego, California, 92120, is hereafter known as the “WEBSITE” or “SITE OWNER.”
You, the “USER” or “AUTHOR” of the WEBSITE must adhere to the following code of conduct and site policies.
This contract is known as the “AGREEMENT.”
BACKGROUND:
The WEBSITE is a cooperative and collaborative effort between AUTHORS and visitors of the site to publish informative content for the good of the general public. All information received and collected on the WEBSITE may be made public at anytime.
OPERATIVE CLAUSES:
1. Appointment as AUTHOR
1.1 The AUTHOR is granted a right to post articles and blogs on the WEBSITE. Nothing in this agreement will oblige the AUTHOR to post editorial content or paid-for text created by, or endorsed by, the WEBSITE.
1.2 The AUTHOR, when accepted as a member of the WEBSITE, will be considered independent contractor and will be paid or compensated as such by our ad revenue system. The WEBSITE will not be held responsible or accountable for paying the AUTHOR directly.
2. Payment
2.1 The AUTHOR will be paid through a revenue share system created by Google, Inc. Payment terms are identified through Google, Inc. on their website www.google.com.
2.2 Should the WEBSITE add additional methods of revenue sharing, the AUTHOR will be responsible for creating their own account in which to benefit from newer technologies or revenue share programs.
3. Code Of Conduct
3.1 The AUTHOR or USER will help to promote the WEBSITE and not create a negative atmosphere with the WEBSITE community.
3.2 The AUTHOR or USER will refrain from extreme racial biases or derogatory remarks that may tarnish the spirit of the WEBSITE.
4. Marketing Support
4.1 The WEBSITE will do its best to market itself, but relies on community support.
4.2 The WEBSITE is not responsible for marketing any particular AUTHOR or blog or article on the website and will marketing at its discretion.
5. Article and Blog Guidelines
5.1 The AUTHOR may not post article summaries only. Any article summaries which simply link to another site goes against the spirit of the WEBSITE and may be grounds for article rejection.
5.2 Blogs will only contain editorial or personal content. The blog system is not intended for commercial purposes. Please use articles for that.
5.3 Articles posted on the WEBSITE may contain out-bound links to other websites, but may not be linked to websites that may cause harm to another USERS computer system.
5.4 Articles written must be original content and the sole work of the AUTHOR. Any copy or text that is copyrighted may be grounds for rejection of the article or dismissal of the AUTHOR.
6. Standards and Practices
6.1 When posting academic or analytical content, please cite using MLA standards.
7. On Termination
7.1 Upon termination of an article, please do what is requested by the WEBSITE administrator. If an article or blog does not meet our editorial guidelines, or our AGREEMENT, then the WEBSITE may choose to reject an article or blog.
7.2 Upon dismissal of an AUTHOR, we ask that you keep our WEBSITE source code, revenue share programs, and company policies confidential.
8. Liabilities
8.1 The WEBSITE will not be held accountable for any illegal action or content created within its community.
8.2 Should legal action or authoritative requests be made regarding USERS and content, the WEBSITE will comply.
8.3 The WEBSITE reserves the right to change or modify its liability policies as it sees fit to benefit the community.
9. Confidentiality
9.1 USERS will not release or make public confidential data learned or gathered from the WEBSITE.
9.2 USERS cannot and will not use personal information of any other USER or AUTHOR for the express purpose of SPAM or illegal activity such as fraud.
10. Governing Law
10.1 This AGREEMENT will be governed by and construed in all respects with the laws of the State of California without regard to its conflict of laws rule.
11. Miscellaneous
11.1 The WEBSITE may choose to update or revise this AGREEMENT at anytime. It is the responsibility of the USER to keep current with the terms of service and the USER AGREEMENT.
11.2 Neither AUTHOR or USER may transfer their account to another party, nor may they subcontract their rights or obligations to this AGREEMENT.
11.3 Failure by the AUTHOR to exercise their rights under this AGREEMENT will not be deemed a waiver of such rights, nor will it prevent that person from subsequently asserting or exercising such rights.
When the USER becomes a member of the WEBSITE, he or she will adhere to this AGREEMENT or may suffer the penalty of losing their rights to write and/or participate within the WEBSITE. Any plagiarism or other illegal conduct can and will be prosecuted to the full extent of the law.
